A letter to the Municipality of West Grey Council: West Grey residents request a hearing on restrictions to public beach access

Dear Chair Hutchinson and SVCA Board Members,

We have the signatures of over 400 residents and community stakeholders of Durham and the Municipality of West Grey and respectfully submit this formal request for a hearing under Section 8 of Ontario Regulation 41/24, concerning the recent decision by the Saugeen Valley Conservation Authority to install perimeter fencing that restricts public access to the beach and riverside area at McGowan Falls, within the Durham Conservation Area.

Grounds for this Request:

1. Lack of Public Consultation

The installation of this fencing constitutes a major change in site use with significant community impact. As per Ontario Regulation 41/24 and SVCA’s own Environmental Planning & Regulations Policies Manual, meaningful community consultation is expected in decisions that alter public access to conservation lands. The only communication provided — a press release on SVCA’s website — does not meet acceptable standards for public engagement.

2. Undue Impact on Residents and Youth

  • McGowan Falls has served as a vital and historic community gathering space. Its closure through fencing disproportionately affects local residents, youth, and families who have limited access to recreational alternatives.

3. Alternative Solutions Were Not Explored Publicly

  • Viable alternatives exist, including fencing and regulating only the parking lot area while keeping pedestrian access to the beach open. These alternatives deserve public review.

4. Transparency and Accountability

  • We seek transparency in the decision-making process, including permit details, community input (if any), and legal rationale for restricting access to Crown-managed or municipally integrated lands.

Requested Outcomes:

  • That a formal hearing be scheduled before the SVCA Board to present the concerns of residents.
  • That the Board reconsider the fencing decision based on principles of community inclusion, balanced land use, and public good.
  • That no further construction or restriction be implemented until the hearing is held and residents are adequately consulted.

Please confirm receipt of this letter and notify us of the proposed hearing date with at least 10 business days’ notice, as per procedural requirements.
